These Terms of Service (“Terms”) are a legal agreement (“Agreement”) which govern the use of all websites ("Sites") and related Services (as defined below) owned, operated or provided by TrendEconomy Ltd (“TrendEconomy”).
For the purposes of this Agreement
- “You”, “your” or “yours” refers to each person who, or each entity that, establishes a User Account and Subscription (the “Subscriber”) or is authorized to access and use a Site or uses a Site without a subscription
- "Services" means the supply of on-line or electronic information, publications and data products (including, without limitation, the delivery of the same over the internet, or via mobile phone apps or other digital devices)
- “Subscriber” means a user of our Sites and/or Services who has registered for our subscription Services and has a User Account. There are three types of TrendEconomy subscription Services: (1) "Free Access Plan" (free of charge), (2) "Basic Access Plan" which is a single-user plan with 3 options: Annual Subscription (annual billing), Monthly Subscription (monthly billing), 1-Month Pass (one-time payment/access for 1 month), 3-Day Pass (one-time payment/access for 3 days) and (3) "Premium Access Plan" which is a multi-user plan with 2 options: Annual Subscription (annual billing) and Monthly Subscription (monthly billing)
- "Content" means all material, data, articles, information and products on the Sites or provided as part of a Service (including, without limitation, any Electronic Books or publications sent by post as part of a Service, but excluding any Posted Material)
- “Derived Data” shall mean any information, algorithm, model, index, score or data resulting from your manipulation or analysis of the Content and/or combination with other data not provided by TrendEconomy, such that the underlying Content is not discernable as being that of TrendEconomy
By using a Site, you consent and agree to comply with all of the Terms of this Agreement. The rights and obligations concerning the use of a Site in accordance with this Agreement are not transferable. If you are a Subscriber, you are responsible for any use of your User Account under your username or password by any person or entity. You are further responsible for ensuring that any use of your User Account complies fully with the provisions of this Terms of Service Agreement.
You are granted a nonexclusive, nontransferable, limited right during the applicable Terms, to access, use the Content and Services made available to you. The rights granted exclusively to are as follows:
(a) The right to use certain Content and Services for research purposes only, unless otherwise stated. Including, the right to copy the Content into your analyses, presentations, documents, and other similar forms of work or research for internal purposes only;
(b) The right to create Derived Data, and publish limited excerpts of the Content in printed or electronic documents, charts, spreadsheets, files, reports, presentations internally and for audit and regulatory purposes, consistent with your ordinary course of business.
Subscribers may pay certain charges in order to receive the relevant subscription Service. Where charges are not published on a Site, the applicable charges will be as agreed between you and TrendEconomy. All charges are expressed in U.S. Dollars exclusive of any VAT or other taxes payable unless otherwise stated.
All payments (including any applicable taxes) must be made in any currency that we may specify. If we do not receive payment for any charges due, we may immediately suspend your rights in relation to the relevant Service (including any relevant Site and/or Content). You are responsible for the payment of all charges associated with the use of the Service, Site and/or Content using your username and password.
"Basic Access Plan: 3-Day Pass", "Basic Access Plan: 1-Month Pass" and "Basic Access Plan: Monthly Subscription" should be paid by credit card. "Basic Access Plan: Annual Subscription", "Premium Access Plan: Monthly Subscription" and "Premium Access Plan: Annual Subscription" can be paid by invoice or credit card.
"Basic Access Plan: Monthly Subscription", "Basic Access Plan: Annual Subscription", "Premium Access Plan: Monthly Subscription" and "Premium Access Plan: Annual Subscription" are recurring and will automatically renew after the end of each paid subscription period.
"Basic Access Plan: 1-Month Pass" and "Basic Access Plan: 3-Day Pass" don’t imply recurring payments.
We do not store your credit card number. Your number is passed directly to our payment services manager for processing.
(a) As a Free Access Plan user, you may cancel your subscription at any time by electronic notice to us using the contact information on the relevant Site or otherwise notified to you.
(b) As a "Basic Access Plan: Annual Subscription" or "Premium Access Plan: Annual Subscription" user, you may cancel your subscription on no less than 48 hours' notice to us by email to take effect at any time using the customer service contact details applicable to your subscription as detailed at the end of these Terms. If you do not cancel at least 48 hours prior to your renewal date, your subscription will be automatically renewed and we will charge your account using the payment method on file for you. There is no refund or credit for unused days.
(c) As a "Basic Access Plan: Monthly Subscription" or "Premium Access Plan: Monthly Subscription" user, you may cancel your subscription on no less than 48 hours' notice to us by email to take effect at any time using the customer service contact details applicable to your subscription as detailed at the end of these Terms. If you do not cancel at least 48 hours prior to your renewal date, your subscription will be automatically renewed and we will charge your account using the payment method on file for you. There is no refund or credit for unused days.
(d) "Basic Access Plan: 1-Month Pass" and "Basic Access Plan: 3-Day Pass" users don't need to cancel their subscriptions as it doesn't imply recurring payments. There is no refund or credit for unused days.
TrendEconomy may terminate this Agreement at any time by providing reasonable prior notice to you. Without derogating from or otherwise limiting the foregoing, TrendEconomy, shall have the right to immediately terminate this Agreement and/or your rights to use a Site in the event of any breach by you of this Agreement.
In the event of a termination of this Agreement by TrendEconomy, TrendEconomy shall refund to you any pro rata portion of the subscription fee paid by you to TrendEconomy, if any, for the unexpired portion of the term of this Agreement.
Once the payment is made:
- No refund is possible for "Basic Access Plan: 1-Month Pass", "Basic Access Plan: 3-Day Pass", "Basic Access Plan: Monthly Subscription" and "Premium Access Plan: Monthly Subscription".
- Regarding annual subscriptions ("Basic Access Plan: Annual Subscription", "Premium Access Plan: Annual Subscription"), refund is only possible within the first 7 days (1 calendar week) following the initial charge. We shall deduct from the refund due an administration fee of US$150.
By accepting these Terms of Service, you agree to receive the information mailings from TrendEconomy. You may at any time opt-out of these mailings by following the “unsubscribe” directions in the email or replying to the email with the word "unsubscribe" in the subject line.
TrendEconomy will not share the personal information we collect from you through a Site with any third parties, except to the extent necessary to provide our Services or when explicitly given permission by the user to do so. This information may be used to better service you and meet your needs. Please refer to our Privacy Policy for more information about the management of your personal information.
TrendEconomy shall have the sole and exclusive right at any time to alter or amend these Terms or to otherwise change, modify or amend the terms and conditions applicable to use of a Site. TrendEconomy shall have the sole and exclusive right to change or discontinue any aspect or feature of a Site, including but not limited to content, functionality, hours of availability, and hardware or telecommunications equipment, software or services needed for access or use.
TrendEconomy will provide reasonable notice to you of any changes, modifications or amendments to this Agreement; however, any use of a Site by you after any such changes, modifications, or additions shall be governed by this Agreement.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT ANY AND ALL USE OF A SITE IS AT YOUR SOLE RISK.
The Content and Services are provided “as is” without any warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Neither TrendEconomy, nor its affiliates, or any of its employees, agents, third-party content providers, or licensors warrant that access to and use of a Site will be free from interruptions or free from errors or defects; nor does TrendEconomy make any warranty as to the results that may be obtained from use of a Site, or as to the accuracy, reliability, completeness or content of any information or service provided through a Site.
You further expressly acknowledge and agree that information, text, graphics, and hyperlinks provided to you through a Site are provided solely as a resource and a convenience to you. Such hyperlinks to other sites are not under the control of TrendEconomy nor do they represent an endorsement by TrendEconomy of those sites. TrendEconomy makes no warranty, either express or implied, as to the accuracy, reliability, or content of such information, text, graphics, and hyperlinks.
In no event shall TrendEconomy, be liable to you or any other person for any loss of business or profits, or for any direct, indirect, incidental or consequential damages arising out of any use of, or inability to use, a Site, including, without limitation, any fault, error, omission, interruption or delay with respect thereto, even if TrendEconomy, were previously advised of the possibility of such damages, or for any other claim by you or any other person. You specifically acknowledge and agree that TrendEconomy is not liable for any conduct of any user.
TrendEconomy will exercise reasonable skill and care in our provision of the Content and Services provided, but from time to time faults may occur, in which case we will use reasonable efforts to repair them as soon as reasonably practicable.
TrendEconomy shall not be held liable for a temporary or permanent loss of service resulting from a change in your e-mail address or contact information, intentionally or unintentionally, which has not been communicated to TrendEconomy in accordance with terms of this Agreement.
As a condition of use of a Site, you agree to indemnify TrendEconomy and/or its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorney’s fees) by your entity arising out of your use of a Site, including, without limitation, any claims alleging facts that if true would constitute a breach by you of this Terms of Service Agreement. If you are dissatisfied with any material published by a Site, your sole and exclusive remedy is to discontinue using a Site.
A Subscriber and TrendEconomy shall use their best efforts to amicably settle any dispute, controversy, or claim arising out of this Agreement or the breach, termination, or invalidity thereof.
This Agreement is governed by and construed in accordance with the internal laws of the Republic of Bulgaria without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to this Agreement or a Site shall be instituted exclusively in the courts of the Republic of Bulgaria.
Nothing contained in or related to this Agreement shall be deemed a waiver, express or implied, of the privileges and immunities of TrendEconomy.
TrendEconomy reserves the right to deny in its sole discretion any user access to this Site or any portion thereof without notice.
No waiver by TrendEconomy of any provisions of the terms and conditions applicable to use a Site shall be binding except as set forth in writing and signed by their duly authorized representative.
No waiver by any party hereto of any of the provisions hereof or of any breach or other default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
Headings in these Terms are for convenience only and will have no legal meaning or effect.
